1. The service

BUNXT is cloud software for agencies and marketing teams. Depending on the plan and the integrations you connect, it may include AI content generation, Meta ads management, WhatsApp Business automation and inbox, CRM, and multi-brand workspace tools.

SocialH4ck LLC provides the technology. We are not Meta, WhatsApp, Facebook, or Instagram. Message delivery, template approval, and API availability depend on Meta and on the networks you connect. We may change, limit, or withdraw features, including to meet a requirement from Meta or the law.

2. Accounts

• You must be at least 18 and able to enter a contract.
• Registration information must be accurate and kept up to date.
• You are responsible for your credentials and for what people you grant access do.
• Email wrojas@socialh4ck.com if you suspect unauthorized access.
• An agency may manage several brands or clients inside its account. It remains responsible for its users’ activity.

3. Acceptable use

You may not use BUNXT to:

• break the law, third-party rights, or these terms;
• send spam, malware, or misleading, hateful, violent, or illegal sexual content;
• impersonate another person or falsify the origin of a message;
• attempt unauthorized access to accounts, systems, or data;
• resell or sublicense the platform unless a plan allows it in writing, such as a white-label agreement;
• use the AI or platform data to build a competing product by scraping or reverse engineering, except where the law does not allow that restriction.

WhatsApp Business and Meta policies

If you connect the WhatsApp Business Platform / Cloud API, Facebook, or Instagram, you must follow Meta’s current policies, including, as applicable:

• the WhatsApp Business Messaging Policy and the WhatsApp Business Policy;
• the WhatsApp Commerce Policy and Meta’s Commerce Policy;
• the WhatsApp Business Solution Terms and Meta’s platform terms for apps and businesses.

In particular, for WhatsApp messaging:

• You may message only people who gave a valid opt-in to receive messages from that business, through the channel and for the purpose WhatsApp requires.
• You must honor opt-out immediately and not message again anyone who asked to stop.
• Spam, purchased lists without valid consent, and attempts to evade template limits, conversation windows, or quality limits set by Meta are not allowed.
• Template, promotion, and conversation content is yours. It must be lawful and compatible with Meta’s commerce and business messaging policies.
• You are the business responsible to your contacts. BUNXT is the technology provider that carries out what you configure.

If Meta limits, pauses, or blocks a number, a template, or the app, we may suspend the affected feature. That is not a breach by us. We may suspend integrations that put BUNXT’s technology-provider standing at risk or that break these rules.

4. Payments and subscriptions

• Some features are free and some plans are paid. The price, currency, and term (monthly or yearly) are those shown in the application at the time you subscribe.
• Paid subscriptions are billed in advance and renew at the end of each term until you cancel.
• You may cancel at any time from the account billing area. Cancellation takes effect at the end of the period already paid. We do not refund partial periods, except where applicable law requires a refund.
• Taxes, withholdings, or bank fees are added when the law requires them or when the payment method charges them separately.
• If a charge fails, we may retry it and suspend the paid plan until it is resolved. The account may move to a free plan if one exists.
• Card payments are processed by an external provider. We do not store the full card number.
• We may change prices for future periods. We will give reasonable notice before a new price applies to a renewal.

Fees Meta charges for WhatsApp conversations, ads, or other Meta services are separate from the BUNXT subscription and are paid under Meta’s terms.

5. Intellectual property

The platform, software, design, BUNXT brand, and documentation belong to SocialH4ck LLC or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use BUNXT while your account is active, according to your plan.

You keep the rights to content, brands, and data you upload or generate (your content). You grant us a worldwide license to host, reproduce, display, and process that content only to provide the service, give support, and comply with law. The license ends when we delete the content, except residual backups for the period in the Privacy Policy.

AI outputs may resemble those of other customers and may be inaccurate. You must review them before publishing or sending them. We do not warrant that an output is original or free of third-party claims.

If you send us suggestions, we may use them without paying you.

6. Privacy

Personal-data processing is described in the Privacy Policy. To request deletion, use www.bunxt.com/en/data-deletion. You are responsible for having a legal basis for contact data you load into BUNXT.

7. Disclaimer

BUNXT is provided “as is” and “as available”. To the extent the law allows, SocialH4ck LLC does not promise that the service will be uninterrupted, error-free, or fit for a particular business result. We do not guarantee approval of a WhatsApp template, delivery or read of a message, ad performance, or an AI result.

AI output is assistance. It is not legal, tax, or compliance advice. You decide what is published and what is sent to your contacts.

8. Limitation of liability

To the extent Delaware law allows, SocialH4ck LLC and its directors, employees, and suppliers are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for loss of data, loss of goodwill, or business interruption, even if advised of the possibility.

Total aggregate liability arising from the service, in any twelve-month period, will not exceed the amount you paid us for BUNXT in those twelve months. If there were no fees, the cap is 100 U.S. dollars.

Nothing in these terms limits liability that the law does not allow to be limited, including fraud or personal injury where such an exclusion is invalid.

9. Indemnity

You will indemnify SocialH4ck LLC against claims, damages, and reasonable costs (including attorneys’ fees) arising from your content, your WhatsApp messages, lack of opt-in, a breach of Meta’s policies or these terms, or use of the account by your users. This does not apply if the claim is caused by our breach of these terms.

10. Suspension and termination

You may stop using BUNXT and cancel the subscription at any time. We may suspend or close access if you break these terms, fail to pay, or if the use puts other customers, Meta, or operation of the platform at risk. Where reasonable, we will tell you first and give you a chance to fix the breach.

When the contract ends, the license ends. Later handling of data follows the Privacy Policy. Clauses that by nature should survive (intellectual property, disclaimer, limitation, indemnity, governing law) stay in effect.

11. Governing law and venue

These terms are governed by the laws of the State of Delaware, USA, without its conflict-of-laws rules. State or federal courts located in Delaware have exclusive jurisdiction, except where a mandatory consumer-protection rule in your country of residence does not allow that agreement.

Before filing a claim, email wrojas@socialh4ck.com. We will try to resolve the dispute in good faith for 30 days.

12. General

• If a clause is invalid, the rest stays in effect.
• Not enforcing a right is not a waiver.
• You may not assign the contract without our consent. We may assign it to an affiliate or a successor of the business.
• These terms and the Privacy Policy are the entire agreement about the service and replace earlier agreements on the same subject.
• Neither party is liable for delay caused by something beyond its reasonable control, including a failure of Meta, a cloud provider, or a network.

13. Changes

We may update these terms. We will post the new version on this page and change the update date. If a change is material, we will give reasonable notice by email or in the product. If you keep using BUNXT after the effective date, you accept the new terms. If you do not agree, you may cancel before that date.
